Gov. Romney Has Another Chance to Refuse to Enforce an Invalid Law

A reader, who is a political activist, is saying that the “Super Commission for Gay Youth,” which was just enacted by the Democratic Party after illegal shenanigans by Speaker DiMasi and Senate President Travaglini, should not be enforced by Gov. Romney because it attempts to create a fourth branch of government.
`           The reader, John Haskins, has a good point because the new Commission is getting $2 million to start even though it is totally independent with no oversight from anyone. The only problem is that we have already learned that the Governor does not have the courage to refuse to enforce an invalid law even though we have shown him the many American leaders who have done so.
The other alternative is to bring a suit in state or federal court to issue an injunction against the law’s enforcement. The first problem with that is finding a lawyer who has the courage and the time to do so. This would entail mountains of research by the lawyer. It could not be done as a lark.
Even if Haskins finds a lawyer, we must remember that both our courts in Massachusetts, state and federal, are captives of extreme liberals. Atty. Chester Darling, who is now retired, can attest to that. Although he won 9-0 in the U.S. Supreme Court on the South Boston parade case, it was a tremendous personal sacrifice for him and his wife who did not get paid (although some may dispute that). The Darlings literally went without food to handle the case.
It became worse after Darling won because the state and federal judges in the state had ruled about 16-1 against him as he went from court to court before the Supreme Court agreed to hear it. This is not something that one should do without great thought and preparation although if a lawyer is experienced enough, our experts tell us it could just happen to be successful.
In addition, although Gov. Romney would not do so himself, he could have the best of both worlds if he told his lawyers to bring a suit. By that method, Romney would not be doing anything except with the advice of a judge.
